Welcome to MyBizOnline. These Terms of Use ("Terms") govern your access to and use of the websites, products, and services (collectively, the "Services") provided by MYBIZONLINE.AI LTD ("MyBizOnline", "we", "us", or "our"), a company registered in the United Kingdom under Company Number 16070269.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

1. Description of Services

MyBizOnline provides an all-in-one, AI-powered business management platform designed for small and medium-sized enterprises. Our Services include, but are not limited to, Customer Relationship Management (CRM), sales and marketing automation, AI-powered voice and chat communication tools ("AI Employee"), website and funnel builders, invoicing, and reputation management. We offer our services through tiered subscription plans ("The Platform") and through a "Done-For-You" implementation service ("The Partnership").

2. User Accounts & Responsibilities

To access most features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

3. Payments, Subscriptions, and Refunds

Subscriptions: All our subscription plans are recurring. By purchasing a subscription, you authorise us to automatically charge your payment method at the start of each billing period (e.g., monthly, annually) for the fees applicable to your plan.

Pricing:

All prices are advertised in GBP and are exclusive of VAT unless otherwise stated. We adhere to a strict Minimum Advertised Price (MAP) policy and will not digitally advertise our packages for a price lower than that of our underlying technology provider.

No Lifetime Licenses:

In accordance with our provider's terms, we are strictly prohibited from offering lifetime access to our platform for a one-time fee. All plans must be on a recurring subscription basis.

Non-Refundable Fees:

All fees paid to MyBizOnline are non-refundable. We do not provide refunds or credits for any partial subscription periods or unused services.

4. Your Content and Data

Content Ownership:

You (and your clients) retain full ownership of all data, text, images, and other content you create or upload to the Services ("User Content").

Our Role as Data Controller:

For the purposes of data protection laws such as GDPR, MyBizOnline is the "Data Controller" for our clients' data. Our technology provider acts as the "Data Processor," handling the data on our instruction. You are responsible for having your own privacy policy and ensuring you have obtained the necessary consents from your end-users to collect and process their data using our Services.

License to Us:

You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and modify your User Content solely for the purpose of operating, providing, and improving the Services.

5. Your Legal Responsibilities & Compliance

Sole Responsibility:

While MyBizOnline provides the technology, you are solely and completely responsible for your business operations and your own clients. You must handle all support, inquiries, and disputes from your end-users.

Legal Compliance:

You are solely responsible for ensuring that your use of the Services, and your clients' use, complies with all applicable laws and regulations. This includes, but is not limited to, data privacy laws (GDPR), anti-spam laws (CAN-SPAM), and telemarketing regulations (TCPA). For all legal purposes, you are the "sender" of all communications initiated through the platform.

6. Termination

We may suspend or terminate your access to the Services at our sole discretion, without prior notice, for any reason, including but not limited to a breach of these Terms or a period of inactivity of 90 days or more. Upon termination, your right to use the Services will immediately cease. Your data may be retained for a period of 90 days, after which it may be permanently deleted.

7. Disclaimer of Warranties & Limitation of Liability

The Services are provided on an "as is" and "as available" basis. MyBizOnline makes no warranties, express or implied, regarding the reliability, security, or performance of the Services.

To the maximum extent permitted by law, MyBizOnline shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services. Our total liability to you for any claim arising out of these Terms is limited to the amount you paid us for the Services in the preceding three (3) months.

8. Indemnification

You agree to indemnify, defend, and hold harmless MYBIZONLINE.AI LTD and its director, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to solicitor's fees) arising from your use of the Services or your violation of these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
